These Terms and Conditions govern your use of the Brain Wellness website. By using this website you accept these terms in full. If you disagree with any part of them, please do not use our website.

1. About us

This website is operated by Brain Wellness Limited, Ten Harley Street, London, W1G 9PF. References to “we”, “us” and “our” are to Brain Wellness Limited.

2. Use of this website

You may use this website for lawful purposes only. You must not use it in any way that breaches any applicable law or regulation, or that is fraudulent or harmful in effect or intent. We may suspend or withdraw all or any part of the website without notice.

3. Medical disclaimer

The content of this website is provided for general information only. It is not medical advice and it is not a substitute for consultation with a qualified healthcare professional. A brain map analysis identifies patterns and supports clinical decision-making; it is not a diagnosis. You should not disregard professional medical advice, or delay seeking it, because of anything you have read on this website. If you believe you are experiencing a medical emergency, contact your GP or the emergency services.

4. Appointments and assessments

Booking a free assessment call through this website is a request for an appointment and does not create a contract for treatment. Any treatment is subject to a separate clinical assessment, and we may decline to provide treatment where we do not consider it clinically appropriate.

5. Fees and payment

Our current fees are set out on our Fees page. Before you commit to any paid service, we confirm the fee and exactly what it covers in writing. Booking the free consultation is never a payment and never commits you to anything.

Where a payment is due, it is taken through our payment provider, Stripe, on a secure page hosted by them. We never see or store your full card details. Card payments, Apple Pay and Google Pay are accepted where your device supports them.

The Stage One fee covers both appointments together — the brain mapping recording and the follow-up appointment, usually 7–10 days later, at which your report is explained. If you choose not to attend the follow-up appointment, the fee is not reduced, but we will always try to rearrange it for you within a reasonable period. Ongoing care, such as psychotherapy sessions or a photobiomodulation helmet, is charged separately as shown on the Fees page.

6. Your right to cancel

Because you are buying without meeting us in person, you have rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This section explains them. It does not affect your separate legal rights if something we provide is faulty or not as described.

Services (consultations, brain mapping and analysis, psychotherapy). You have 14 days from the day we confirm your order to change your mind and cancel, without giving a reason. If you ask us to carry out a service within that 14-day period, we will ask you to confirm that you want us to begin. In that case:

• if you cancel after the service has been fully provided, you no longer have the right to cancel it;
• if you cancel part-way through, you pay a fair, proportionate amount for what has already been provided.

Rescheduling an appointment. Separately from the above, if you need to move or cancel a booked appointment we ask for at least 48 hours’ notice so we can offer the slot to someone else.

The photobiomodulation helmet (a device you keep). You have 14 days from the day you receive the helmet to change your mind. To do so, tell us within that period, then return the helmet to us within 14 days of telling us. You are responsible for the cost of return unless the item is faulty. We may reduce your refund to reflect any loss in value if the helmet has been used or handled more than was necessary to check that it works.

How to cancel. Tell us by email at info@brainwellness.co.uk or by phone on 0207 467 8536, quoting your name and the payment reference. A clear statement that you wish to cancel is enough; you do not have to use a particular form.

7. Refunds

Where you are entitled to a refund, we make it using the same payment method you used, through Stripe, and we do not charge a fee for doing so. We make the refund:

• for a service, within 14 days of the day you tell us you are cancelling;
• for the helmet, within 14 days of receiving it back, or of you showing us that you have sent it, whichever is sooner.

If treatment cannot go ahead for clinical reasons after you have paid, we refund the fee for any part we have not provided.

8. Intellectual property

All content on this website, including text, images, video, graphics and design, is owned by or licensed to Brain Wellness Limited and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or exploit any part of it without our prior written permission.

9. Third-party links

Our website may contain links to third-party websites. These are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them, or for any loss arising from your use of them.

10. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law. Subject to that, we do not accept liability for any loss or damage arising from your use of, or inability to use, this website.

11. Privacy

Your use of this website is also governed by our Privacy Policy and Cookie Policy.

12. Changes to these terms

We may revise these terms at any time by amending this page. Please check this page from time to time to take notice of any changes.

13. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
